Kuwait's Penal Code punishes gambling in a public place with up to three months in prison and a fine, rising to a year for a repeat offense within twelve months, and punishes anyone who runs a public gambling place or takes part in organizing, supervising or equipping gambling with up to two years. There is no gambling regulator, licence or lottery, and the Ministry of Interior treats the use of illegal online gambling sites as a punishable offense. Enforcement moved online in 2025–2026: the Interior Ministry dismantled a network running a gambling website in November 2025, and in January 2026 the Criminal Court jailed nine defendants for seven years each with KD 1 million fines, fined a linked company more than KD 1.8 million and barred it from business permanently.

Kuwait gambling licence: how it works

There is no Kuwait gambling licence and no authority that could grant one. Article 205 of the Penal Code defines games of chance as those in which the prospect of gain or loss depends on luck rather than factors that can be determined in advance, and punishes both the player in a public place and, more severely, anyone who runs a gambling place or participates in organizing, supervising or preparing the means for play. Online cases are charged under Article 205 together with money-laundering and cybercrime provisions, as the 2025–2026 prosecutions show. A foreign operator has no application to make and no lawful basis to accept residents of Kuwait; local agents, payment intermediaries and promoters are the people prosecuted.

Outlook

No change is expected in the law. The 2025–2026 prosecutions show that Kuwait now pursues online gambling as organized financial crime, with heavy sentences for operators and payment facilitators, and the Interior Ministry has said it will take the strictest measures against anyone using cyberspace to undermine the financial system. No proposal to license any form of gambling has been made public.
