Is online gambling legal in Peru?
Law 31557 (2022), amended by Law 31806 (2023) and regulated by Supreme Decree 005-2023-MINCETUR, created a national regime for remote games and remote sports betting supervised by MINCETUR's Directorate General of Casino Games and Slot Machines (DGJCMT). Authorizations are granted separately for casino-style games and for sports betting, last six years, require a 200 UIT guarantee and a .bet.pe domain, and are open to Peruvian companies, branches and foreign-incorporated companies. Operators pay 12% on net monthly income after a 2% maintenance deduction, and since 1 July 2025 players pay a 1% selective consumption tax on every bet; MINCETUR counted 92 valid authorizations in May 2026.

Who regulates gambling in Peru?

- Superintendencia Nacional de Aduanas y de Administración Tributaria (SUNAT) — Collects the 12% remote gaming and betting tax and the 1% selective consumption tax, including from non-domiciled operators
Peru gambling licence: how it works
An operator applies to MINCETUR for an authorization to exploit a technological platform for remote games (casino, live casino, poker and similar) and separately for remote sports betting; each is granted for six calendar years, renewable for equal periods, and is personal and non-transferable. Applicants may be companies incorporated in Peru, Peruvian branches of foreign companies or companies incorporated abroad, subject to legal, technical, financial and background reports on the company, shareholders, directors and managers. The platform and its games must be certified by a MINCETUR-authorized laboratory and registered, the operator must post a guarantee of 200 UIT per authorization (plus 5 UIT per physical betting shop), give MINCETUR and SUNAT real-time access to technical and economic data, and operate under a .bet.pe domain. By May 2026 MINCETUR had 92 valid authorizations, 349 registered service providers and eight accredited laboratories.

Gambling taxes in Peru
- Operators: Impuesto a los Juegos a Distancia y Apuestas Deportivas a Distancia of 12% on the taxable base, defined as monthly net income (bets received minus prizes paid and returned bets) less a 2% maintenance deduction; ordinary corporate income tax applies in addition. Non-domiciled operators register with SUNAT and pay through Virtual Form 696, in soles or US dollars.
- Players: A selective consumption tax (ISC) of 1% on the value of every bet since 1 July 2025 (0.3% from January to June 2025), with the player as taxpayer and the operator as collection agent; prizes are not otherwise taxed.
- Also: Tax revenue is split 20% to the Treasury, 20% to the Ministry of Health for mental-health programs, 40% to MINCETUR (part earmarked for enforcement) and 20% to the Peruvian Sports Institute. MINCETUR reported S/208.8 million from the two remote taxes for January to November 2025 and more than S/266 million for January to May 2026.
Advertising, player protection, KYC and payments
Advertising
Advertising is permitted for authorized operators and may not feature minors or messages aimed at them; unauthorized platforms and their promoters are targeted by MINCETUR's monitoring of social media and influencers, and sports insiders may not bet on events they influence.
Responsible gaming
Age 18+, a national Ludopathy Register administered by MINCETUR that enables self-exclusion (4,433 people registered by mid-2026), deposit and session tools, and prohibition of play by persons with influence over sporting outcomes. Welcome bonuses are allowed only if they cannot be converted to cash; bonuses paid on winning plays may be cashable.
Identity and age verification
Verification of identity, age and nationality or migratory status at registration, one account per player, payment instruments that identify the player, and SPLAFT monitoring with suspicious-transaction reporting.
Payments
Deposits may be made in cash at authorized betting shops, by debit or credit card or by any other payment method accepted by the operator that identifies the player, except cryptocurrencies, which Law 31557 excludes; prizes are paid to the registered player's account at an institution supervised by the SBS.
Notable restrictions
- Cryptocurrencies are not an accepted payment method
- Minors and persons who can influence sporting outcomes may not bet
- Welcome bonuses may not be converted to cash
- Only .bet.pe domains may be used for authorized platforms
- Unauthorized platforms face fines of 1 to 200 UIT, blocking by URL, IP, domain or DNS through the MTC, and up to permanent disqualification
Peru iGaming market: size, players and payments
MINCETUR reported S/208.8 million of remote gaming and betting tax for January to November 2025 and S/266 million for January to May 2026; at the 12% rate the 2025 figure implies a taxable base of roughly S/1.7 billion for those eleven months. The total gambling sector, including land-based casinos and slots, paid S/419.5 million in taxes in the same 2025 period.
No official participation survey; the DGJCMT counted 4,534 authorized betting shops nationwide in May 2026 and 62 authorized companies (57 Peruvian and 5 foreign) behind the 92 platform authorizations.
Play is mobile-led and instant wallet transfers through Yape and Plin are the dominant deposit rails alongside cards and cash at the thousands of licensed betting shops.
About 55 authorization holders including Betano, bet365, Betsson, Betcris, Inkabet, Doradobet, Apuesta Total, Coolbet and Stake compete alongside strong local retail chains; in 2026 the DGJCMT removed 116 illegal sites, made 2,583 inspection visits and seized 156 terminals and devices by mid-year.

Peru's regime is stable and growing: authorizations are being renewed and extended, tax collections in 2026 are running well ahead of 2025, and enforcement now focuses on blocking unauthorized sites, illegal advertising by influencers and clandestine terminals. Watch for MINCETUR directives on responsible gaming and payment identification, possible adjustments to the ISC, and the first renewal cycle of six-year authorizations from 2030.
